Rental car companies scamming?

Recently rented from Hertz at Sea-Tac airport. Generally a bad experience but my question is specific. We rented a Mitsubishi Mirage. Fuel tank capacity is 9.2 gallons. Since I was unhappy with the service I looked over the contract today and noticed that it lists the fuel tank capacity for that car as 14.5 gallons. This means that if you purchase the fuel option in advance you will be charged for 5.3 non-existent gallons. I wonder how often this scam is occurring. Has anyone here checked the listed capacity on a rental contract with the actual capacity of the fuel tank? Multiply that 5.3 gallon fuel cost times thousands of contracts and Hertz is stealing a lot of money.
