I think you need to have something called a shift interlock cable adjusted. I think that's what it's called. When I got my 1999 ML 320 I could remove the key when the vehicle was not in park, the dealer adjusted the cable or whatever it's called under warrranty. I was told it takes like 5 minutes to adjust. It's not a big deal to adjust.
