It was a very nice SD, but I think you need to take the settlement with the buy back option. Find another nice SD, and you have parts galore to sell. Many folks here could benefit by the very nice parts left over [after you get what you need]. You will no doubt benefit financially also.
But that brings me to the sad part, the loss of your car. That is the other side of the coin that you must reconcile.

I hate to say it but I'd take Jim's advice. Buy back the car, and use the money to buy a nice rust free southern SD.


Always play hardball with an insurance company, you don't have to take their first offer either.

Total BS. What is 'whip-lash' then? Folks are sued all the time for this painful injury even though it isn't permanent. ANY pain or stiffness is grounds for compensation.

Here's a true story, no BS. When I was 16 and learning to drive, I was in an accident with my mother's Jetta. The other party sued, and one of their claims (which they won) was for 'distress and mental anguish', and another claim was for 'reduced sexual performance' (not joking here) as a result of the mental stress of being in an accident. Another claim was for loss of wages due to attending 'rehab sessions' for the couple's loss of sexual performance. Good thing I was well insured and didn't paying anything out of pocket, but they were awarded $25k for that. Not kidding. They won $25,000 for that bogus BS.

Unfortunately, I think they only way you'll be getting any reasonable amount of money here is to retain an attorney and sue the other party. It's an easy win for you since they were obviously at fault, the only question is how much $$ you'll be awarded.

See, I would have gone to the hospital, and cashed in on this whole deal, and buy the car back, too. This could all be very good for you financially. It's how I got my start. Head on Collision, by a tractor trailer a few years ago. I was in my Peterbilt, and had a lot of fake injuries which I still fake suffer from, and cash in for real on, in monthly LARGE sums of money. You have a clear cut, open-closed case here. Rear-ended, by someone who was clearly negligent... Talk to a good lawyer, and you can have several of these cars in the next few years. Either way you go though, I wouldn't part with that stick shift 126 car.... I'll give you the $5,000.00 for it, as is, and find a parts car with a good body to rebuild it out of. Or just the stick shift components, tranny, etc, and be done with it.

I got my toolbox freed from the rubble; it too was totaled.

Another insurance adjuster stopped by, this time from State Farm. He'll officially weigh in with an assessment next week, but his initial reaction was that I should reclaim the car, even if totaled. If it were his, he would rebuild!

The rarity of the car makes it worth much more than what they are offering you. Why not get it independently appraised by a reputable company that appraises 'collector' cars? Show it to the insurance company and then see what they say. I assume this is what people who drive custom hot rods around do.

Our '83 300SD (my dad's) got rear ended today too. 20ish mph while he was at a stoplight in the middle of the city, some loser smashed right into him straight on, pressed the bumper 1" into the car, deformed the side fenders/body panels on both sides so the seams by the rear doors are about .01mm instead of the 2mm they should be. It also slightly wrinkled on the passenger side.

Worst part is, right after hitting him, the jerk backed up, went around him breaking all kinds of traffic laws, ran a red light, and took off at top speed down a city street (30mph limit). Hit and run. Didn't even have a chance to get his plate # or car make or anything.

The car isn't "too" smashed, its hard to tell from 5-6 feet away, but up close you can tell. I'll make a thread on it tomorrow.

Our poor '83, it just keeps getting beaten on. At some point we may just need to find a donor body for the drive train. (Which is in perfect shape)

That's very fixable IMO. Just find a nice donor car for the rear and get it done.

Sigh. The bit about talking to an attorney is good advice. Take the rest with a grain of salt. Folk, please remember that different states have different laws, so that a "slam dunk" under the law where you live could be very different some where else. Pennsylvania (judging from the car's license plate) is a wierd mix of no-fault (where everyone's own insurance pays) and fault (the guy causing the accident pays). It may be true that you can recover, it also may be true that a muscle strain won't cut it. Talk to someone who knows, and find out for yourself.

Good luck on repairing/replacing that beautiful car.
