They towed my car with rear wheels down

Guy asked me if it is rear wheel drive and I said yes. So I left to met him at the mechanic and he came towing car with rear wheels down in neutral.
I cannot start my car so I am waiting tomorrow to see if they f$#3$$ my tranny. Can I sue them if my trannsmission is fried now. I am so pissed. It is 1987 300D

Rule # 1 (AND 2)

1.Do not allow Mercedes to be towed with ANY wheels on the ground!
2.Do not allow Mercedes to be towed Unless You're present!

You May Sue anyone for Anything...

I'd be discreetly finding out who their Liability Carrier is.

Amazing stupidity especially in a country where most vehicles have automatic transmission...

Hopefully your transmission has a rear pump which allows tow starting and limited flat towing. From some point in the 90s the rear pump was no longer installed at the factory. [edit] Oops, it's the 87 300D. Hopefully the tranny wasn't rebuilt leaving out the rear pump.

Hopefully you took a picture of your car hooked up to the tow truck in the manner you described.

Hopefully someone can describe the symptoms of a transmission damaged by flat towing.

A friend of mine removed the rear (also called secondary) pump from two 87 TDs and an 87 SDL using late 722.3/4 blocking plates as a delete kit. He was told by a rebuilder that some rebuilders don't reinstall the rear pump as a matter of practice. That's a debate worth it's own thread.

The rear pump relies on front pump pressure to disengage. If there's a pressure loss while the car is at speed, the rear pump drive will try to engage the spinning jackshaft and probably make a mess of things. Which is not to say that losing pressure at speed wouldn't make a mess of things anyway. This is not a problem when the car's not moving, or if the car moves with the engine off. Up to a certain speed, anyway.

The rear pump was removed for the 1991 model year.
