Dude, A couple of points.

Bill and I came to the same conclusions without talking to each other. When two ( or more ) people come to the same conclusion perhaps what they are saying is true.

We were not battling fine points on when the use " a " or " an " , your post is borderline illegible. The buyer apparently was illegible in communication as well. Non specific goals, communicated in a non specific manner, will yield non specific results.

I'm guessing you run your life like this as well and blame others for your misfortunes. At this point you have a choice, get your house in order or be doomed to struggle for the rest of your life.

I disagree here...

A deposit belongs to the seller. It is funds promising full sale completion.

Only refundable if the seller backs out of the sale...

I don't fully agree. If the buyer has stated expectations that aren't met by a certain date, the buyer can call off the deal and demand return of the deposit.

I think the learnings for the seller here are: avoid emailing or texts with buyers - period. No sarcasm or jokes intended with this advice. Clear email comm can be hard on a good day, even for people who's job is to write. Arrange and communicate all sales in person or over the phone.

Legally you're better off having everything in writing, however. Email and text are both considered "in writing" in court. Verbal agreements, while legally valid, are rarely worth the air they were uttered with as there's usually no proof.

I still don't quite understand what happened here, so I can't comment on that. Seems like it's been beaten to death though.

Who owns the deposit depends on how the contract is written. I would never sell a car with a promise to fix x, y and z. I would never buy a car demanding the seller to fix x, y and z. I just take the cost of repair off the sale price. IMHO, the pain is self inflicted, period. If it were me, I would not post or rant here. You get no sympathy on forum.

Same tone but directed to one who trolls .Knowing that behavior exists it sounds right to address it ,the only good troll is a quieted one, good little trolll.
Im coming to understand that some here are to help and alike ,but others like to needle for behavior that suites their little mind .To twist or project themselves out of a somewhat bored existance they live. It is sad but its their existance Im putting light on and the light will remain till they go back into their little troll hole.

Buying and selling used cars between private parties - non-dealers, is a mine field I'd just as soon avoid. Hopefully, I won't be negotiating that process anytime soon. It can be a tough process. That's for sure.

After reading most of the OP's posts here on thread - this just about nails it with pinpoint accuracy - in my way of thinking too.

Boy, this is a really tough audience. My point, way back there, was just not to give up. I have rarely found that giving up helps.

Dealing with people in business you find out the worth of each person. All of a sudden that smiling friend of yours turns into a real nasty wretch when it comes to the almighty dollar. It really helps to show the colors of some people. So....If you sell something, make sure you keep records of everything. Be firm but fair. And establish your conditions. Conditions not met? Tell them to take a hike. If you're selling something they want, they'll find a way to pay for it.
