That's backwards. Find me a car (other than my Benz) whose speedo doesn't read at least 5mph high at 80.

Lacking proof that it was recently calibrated, the policeman should not be using it as "proof" that someone was speeding.

IIRC, years ago when they paced, they would write down that the speedo was calibrated on MM/DD/YYYY. Besides, the burden of proof is on the cop

We're not talking about "a" car -- we are talking about a cop car. A calibrated speedometer is a standard component of police packages.

As to your point about whether it was recently calibrated, that's a different issue.

Perhaps so. however, an uncalibrated speedo or one that wasn't calibrated recently does give doubt as to whether it is accurate. Just because you started out calibrated doesn't mean you are still calibrated today.

As the tires wear, the speedo will creep up. Unless they're using their radar gun to gauge the speed of the patrol car, that is.

For him to pace you, he'd have had to stay on your tail and match speeds. If he saw him coming up from behind gaining, and then the flashers come on, it was never paced correctly.

Danny,

The cop gave you a present by writing up that ticket. He was being nice and writing you up for less.

Shame you're not in St. Louis...traffic law centers all over, pay the att'y $40 per ticket, he'll mail you a statement showing the amount of the fine for your "defective equipment" or "littering" or whatever violation he scammed the court down to and the amount of the fine, due via US Mail to the court within 14 days...no points, and att'y makes a buck, the court gets a larger fine than they would have otherwise, everybody goes home happy. DWI's can't be fixed, but I suspect anything else can.

Yeah he did. He also gave me a present by not writing in the fine. I think I'll just fill it in with a big fat zero and send it in.

Danny

It is a moving violation. I'm sure there are points involved.

Then the answer is simple. Lie like a rug and fight it.
