It sounds like you know little about how criminal law works in this country.
I know next to nothing about this case as regards what happened historically in court; BUT: If he was acquitted by a jury 12-0 (unanimously) on all the charges, it's OVER,and he walks. And if acquitted 12-0 (unanimously) on ANY charge, that charge is then gone, he walks on it.... BUT, if it was a "HUNG JURY", ie, 11-1 or 6-, etc on any charge, the Prosecutor has the right to refile, over and over, and try the case again, over and over, and it is NOT "double jeopardy" or violative of his Constitutional Rights.. Zero. Once a criminal defendant is acquitted, the Double Jeopardy Clause says that's the end of it. No retrial for the same offense.

DeLay was tried in Austin because it is the state capital and he broke a state law. It is the job of the DA in Travis County to bring charges against lawmakers if they break laws in Texas.
The DA there, Ronnie Earle who is now retired, has also sent a number of Dems to jail. You don't hear the Republicans mention this since it destroys their 'it is so unfair' argument. DeLay also had Dick DeGuerin as an attorney. Since he is considered one of if not the best criminal lawyer in the state it will be hard for DeLay to argue that he was not represented correctly. |

As far as I can tell DeLay has not had any charges against him dismissed. He was looked into by the Justice Dept. for his involvement with a convicted lobbiest that sent two other Congressmen to prison, but DeLay was never charged with anything concerning that.
There is a difference between never being charged with something and being found not guilty of it. |
