CRS 18-1-901(3)(g) "Dwelling" means a building which is used, intended to be used, or usually used by a person for habitation.

Detached garages, tool and garden sheds, and the like are generally covered under most homeowner's policies, so long as the structure was on the property at the time of the issuance of the policy and the contents stolen weren't of such value or uniqueness that would require special or separate disclosure. For instance, a hammer would be covered, but a mult-carat, jewel encrusted 24K gold hammer would not.

The odd thing in this case is that it is a garage that is on a rental property I own. Both my home and the rental property are insured by the same company.

That thought did cross my mind. Either they were interrupted in the act of burglarizing, are very selective in what they steal, had a full truck, or knew exactly what they wanted and only took that stuff. Not many people knew what was in that garage. In fact, upon reflection, I don't know anyone besides family members who knew what was in there.

Also make sure to season the crime scene a bit by putting an air soft pistol in his hand. You know.

Around here the leo would advise you to defend yourself and your property as you needed to. It is 1/2 mile from my house to the gate that stays locked and there are three big dogs between here and there. The dogs are one of the best alarms you can have. As a matter of fact they provide you enough time to be selective in picking out the firearm you want to head outside with (versus picking up the one you are closest to). You never know what kinda thief meth head you are going to come accross this poor, poor area. Anyway, unless they had night vision it would be hard to maneuver around between here and the gate. Most folks are pretty scared to come down that dirt road. I guess it has something to do with the signage on the other side of the gate.

Not sure how the insurance will be handled.

If I read the post correctly, it was your rental property's garage being burgled and not your own home's garage. The stuff stolen belonged to you and not the tenant.

Rental insurance normally does not cover owner's belongings. Not sure that you have a claim against the insurance.

True, but I don't think he'll be making a claim under any tenant's renter's policy. The claim would be under his own policy, issued to the property owner/landlord.

Correct. I have a landlord policy on the property where the garage is located and a homeowner's policy on my own house which does not have a garage. Both with American Family. It's an unusual situation. Not sure what will happen.
