This change in policy is actually in response to a Federal Court Order from 2005. It says that if there is a legal driver able to drive the car away it cannot be impounded.
The 'reasonable time limit' is about one second. If there is not a legal driver in the car to drive it it will still be impounded. If the driver cannot produce a valid ID they are still subject to arrest, and this is the case with anyone. Sam Francisco and other large California cities have had this policy in place since 2005. It is to keep drivers that have no permits from crashing through checkpoints in order to flee which was something that did happen from time to time. The LA Times did a big article on this on April 29, 2011 which is probably still online. And... The Latino group that was pushing for LA to follow the guideline of the Court Order was the Southern California Immigration Coalition. Juan J. Gutierrez and his group have so far has had no comment on this and had nothing to do with getting this in place. |

The way I read that article, they don't have two sets of rules anymore. Before the change in policy, a legal citizen without a license was given a reasonable time to get a licensed driver to drive the car away. Illegal immigrants stopped at checkpoints had their cars towed automatically. Now the rule is the same for everyone. Seems OK to me.

Different Rhetoric in Alabama
Brooks hails from Alabama, where governor Robert Bentley recently signed one of the toughest immigration laws in the nation; among other things, it mandates that public schools check students' immigration status, allows police to arrest suspected illegal immigrants stopped for other reasons, and criminalizes giving a ride to someone you know to be an illegal immigrant. Like Arizona, Law Enforcement is Not On Board with Immigration Law "If we do arrest these folks, how are we going to house them? What are we going to do with them when we get them?" he said. "Also, if we arrest someone who has children with them, what do we do with the children? A lot of these things are not clearly defined and it's going to add a lot of expense and put more burden on law enforcement and other public governmental entities, such as the Department of Human Resources." |

A careful reading of the actual article shows that things have been equalized and illegals are now receiving the same treatment with respect to their cars that citizens have. That's all it's about. It's not about busting illegals, and it's not about drunk illegals being allowed to drive away. Big deal.

Have you been there? Border towns don't count. I have a hard time imagining why anybody'd want to enter Phoenix, but that's because I was born there and know a few things about the place.

DUI checkpoints shouldn't be "papers please." They should just check for DUI, not be an excuse for a general sniffing expedition. (I've been stopped in NJ, and they're only allowed to check for intoxication, not run your license unless you were doing something else illegal.)
