It is clear that some violations of the TOU are permitted and some are not, how that comes to be is completely unknown based on the apparent history of selective enforcement. Maybe it's only enforced when people with favorite moderators report it, maybe it's enforced only when confidential informants report it, maybe it's only enforced when confidential informants and favorite moderators disagree with certain forum members?
It's clear that there are numerous times where moderators participate in a thread wherein the TOU violations occur, maybe the mere fact the violation occurs and is known is insufficient to compel enforcement. Maybe it's only when someone elects to be offended by something they chose to read and communicates such offence to the moderator it rises to a violation.
I do find it very amusing that some of the most virulent and demanding of “forum law and order” characters not only regularly violate this ENHANCED ENFORCEMENT TOU provision but they also seem to enjoy immunity from doing so! That in the process it exposes some hypocrisy is priceless.
It’s also just another example of the unintended consequences of piss poor rule making.
