I've never taken any moderation action against anyone for copyright violations because I don't really understand it myself. Coincidentally we have been discussing it in the moderator forums as well.

The post was reported by the former moderator that wrote the enhanced TOU and another moderator acted based on the current TOU setup. It was not politically bent, it was only acted upon because it was reported. Obviously this is not a perfect system, but we are human and imperfect individuals trying to do the best we can.

Bill (the former owner and webmaster) was very worried about getting in trouble for copyright violations by members posts and ask that we step it up. This seemed to be only with text, not pictures or graphs. The new owners have looked at the same laws and have a more Laissez faire attitude towards it. It seems the posters are liable for copyright infringement and we are insulated as a mere conduit, but there's no clear definition as to what constitutes crossing the line.

This is something we are discussing and hope to have a clean cut resolution on soon.

What I have never understood, Billybob, is why the hell you are always so critical of us. There are so many other greater injustices in the world than our imperfect moderating style yet you spend so much time and energy postulating that we are politically bent, reactive, hypocritical, bumbling idiots. You've been banned once for getting too critical with us yet you continue to do so.

I've made this suggestion once before and I'll say it again. Find a better use of your time and intellect. We are volunteers doing this for free with good intentions trying to keep a fun OD atmosphere while keeping with the wishes of the ownership to the best of our ability. So far no moderator has ever met your high standards, but you get what you pay for. We are not perfect individuals and never will be. Sometimes we do things inconsistently, but C'est la vie.

Damn, so TomW reported that sjh violated TOU provision?

And it wasn't a group decision as a moderator stated, it was a single moderator that decided it was a violation?

And the violation was only for the cut and paste of the copy righted written text portion not the cut and past of the copy righted text/picture as a moderator stated?

And when you state that it was not "politically bent" are you refering only to the decision that it was a violation? Or has the the person who reported the sjh posting as a alleged violation also been reporting any other alleged violations?

"There was an initial complaint regarding the post that led to all this. The complaint was that Forum copy write rules/regulations had been broken. We as moderators discussed how to handle the posting. We interpreted that the cut/paste of Copyrighted text/picture is against the rules for posting. We discussed various ways on how to handle the posting and one of the ways was to delete everything except the first few words of the title and leave the link in post #1 which is what I did. "

There was a discussion that I was not involved in until much later. We are still discussing the matter.

What's obvious is SJH overreacted to having is graph deleted and had a massive melt down, then starting deleting every one of his posts and wanted us to completely delete his account. This very benign action (justified or not) did not excuse his incredible reaction.

Everyone, including you is entitled to their opinion as to what constitutes an appropriate level of reaction, yours has been expressed.

Thanks for outing the original complainant, it might have surprised some, but not all!

Billybob your post #27 is not totally accurate.

I used the sjh incident as a learning experience which should result in being a better moderator.

Well I'm pretty sure I posted what had been stated word for word what Tyler said and what you had said, and I asked a couple questions for clairification, so I'm not sure what any inaccuracy would be but I'm always happy to have it pointed out.
