Did they have a warrant to enter the premises where the fellow was shot? If so, then they can easily claim they thought he had a gun. Happens all the time here in NYC. The DB's here killed a Marine on the Grand Central Parkway who wasn't threatening or harming anybody. Cop got scared when the Marine reached for something.............. I hope they take the Police for millions.
A long time ago a Mail Carrier shot a Dog and they indeed awarded Pain And Suffering because the Family had Kids and the Kids were traumatized that someone shot their Dog.

I don't think we are talking about shoot first and ask questions later. If you were given the order to "freeze" and you still move, are you asking the cop to find out whether you are going to shoot him the hard way or not?

I do, as well. However, I haven't heard squat regarding this case. I sure hope it does not disappear, however there has definitely been no indictments handed down.

Regardless, my point was that in the previous case, you seem to want the cop to be the sacrificial dummy by saying that in spite of being ordered to stop the victim did something stupid but the cop is supposed to wait till the weapon is clearly visible before defending himself. If you broke into my house and I had a gun on you and you made a sudden move, I'd shoot. If that is how I would do it, how do you think I can ask a cop to make 100% sure before he defends himself. Regardless of whether I like them or not, I don't think it is fair to expect them to stick their neck out further than I would be willing simply because you didn't understand that I had a gun on you and it is in your best interest to cooperate.

When I get pulled over, I don't make any moves until ordered and announce exactly to the cop what I am going to do and move SLOWLY.

I agree with everything you opined here except this. If they wait to see a weapon it may be too late. Obviously we need a higher standard than what is in place now but I don't know what that standard is. I agree that cops are too trigger happy- but people are effn stupid, idiotic and unpredictable. Far too many DB's from our broken multicultural society.

That is the crux of the issue with me too. What he seems to want is the cop to wait till your stupidity unfolds to take defensive action. I mean, when you are staring down the barrel of a gun and you make a move, how would I know what you are trying to do? We don't live in Mayberry RFD anymore. I can't be sure if you are reaching for a toothpick or a gun. So the only thing we can do is to say the cop has to hold his fire till he sees the weapon which might be too late and he or someone else gets shot. So the question is, would YOU take such a job? I wouldn't unless I had a death wish or a terminal illness and a great insurance policy that protects my wife and kids, etc, etc.

This is something that happened to Me.

I was driving by a School and came to an intersection with a Stop Sign (narrow residential Streets).

Acrossed the intersection was a Police Car and 2 Officers with what I guess was a Suspect sitting against the School Chain link Fence.

From the Sidewalk the one Officer saw Me and pointed His Flash Light at Me in a manner that made me think He wanted Me to go around them. I also saw a Hat in the Middle of the Road near them and thought that He wanted Me to go around that; evidence maybe?

So I pulled away extremely slowly to go around the Hat and as I was doing the Office stepped Towards Me still waving the Flash Light in the same Manner and I continued and He kept waving and advancing until He partially blocked My way.

I stopped and He went on as to why I continued to come forward instead of making a left Turn; apparently He was not waving Me around that Hat and did not want Me to go straight down hat Street.
He had stepped in front of My Car He also said He thought I was trying to run over Him.

So I ended up backing up the Car and going the way He wanted to.

This is what I got from the Experience. The Officer some how expected Me to know what He was trying to communicate to Me when He was waving the Flashlight.
The got from the comment that He though I was trying to run over Him that that particular Officer must be a little paranoid.

I also know from some training that I had in the past you can't effectively direct traffic from the Sidewalk.

As I thought about it later I came to the conclusion that the Poilce Officers are a groupe of People that extremely isolated from the main stream of the People and they have their own group think and values. They don't ever get to have a normal life even when they are off duty.
And, that that isolation and the part of the Public that the do deal with does not leave them in a normal frame of mind.

Now what do you suppose would have happend to Me if I had gotten mad at being accused of trying to run over the Officer and talked back?

The way things are going today, I wouldn't call it paranoid.

Well, nothing good will come from that obviously. How would I take it if my employee got mad and talked back to me? Probably not well either. OTOH, if they calmly explained themselves, it probably goes a lot further. Same as with a neighbor or whatever.

As I told you, you can make it to be whatever you wish because there are no facts other than the witness in the vehicle. It would appear to me that there was no desire on the part of the police to wait until they were threatened in any way.

Nobody would expect an officer to take a mauling from any dog, regardless of the reason or lack thereof for the encounter...However, in a circumstance of being in someone's fenced backyard and shooting the family dog, the officer should make every attempt to remove himself without using lethal force on the dog, even if it included getting bitten a few times.

Remember, serve and protect.

Over being cut off? Seems kinda lot of effort over one simple thing and with so many other people around. If I was going to do something illegal, I'd make sure nobody else was around. They do say that 2 men might keep a secret if one was dead.

Is it your contention that they just burst in with their guns blazing? Based on experience with being stopped, I can't say that I believe that was likely.

How would you do that? If you see someone reaching into a jacket for something, how do you determine if that is a weapon or not without putting themselves in line for a bullet? Do you understand the risk you are asking someone to take in this day and age?

Did they say who they were serving and protecting? Must it be you? They were protecting themselves first. Something I'd expect anyone to do.
