I have never understood the logic behind that argument, but you hear it a lot.

And it is goofy. If my car is swiped and used in a crime what am I supposed to do about it? And its' the same with anything else.

What if your money is taken from you and then used to purchase an illegal item. Was your money used in a crime?

Do yourself a favor and google "proximate cause doctrine", migheven happen that one of the forum's resident barristers will chime in with a tutorial for you.

In broad terms the general rule is that a gun owner would be no more liable for the criminal use of their stolen gun than a car owner would be responsible for the criminal use of their stolen car. There is a vast collection of case law that provided precidence for this.

Damage to another persons roof is most probably a cause for civil action a "tort action", a crime would more than likely require an intent to cause harm or damage or a willful disregard.

The gun IS locked up in my house. Anybody who has entered the house without my permission has done so illegally.

Is there a bigger penalty if the safe is cracked after a home B&E?

Maybe... They would have stolen it anyway??

Hey... I left the Plutonium sitting right on my kitchen table.... how was I supposed to know that Gangnam-style would steal it??

I thing it is illegal to own plutonium. Not sure.

If you have it on your kitchen table don't worry about getting arrested. You're already dead.
