Also, A&E is a commercial enterprise and it is right and proper for them to be swayed by public opinion to maximize their profit. The niceties of constitutional law come second.

At a Christmas party tonight this came up. A lot of lawyers were there and they were beating this to death.

They did agree that this is not a first amendment right. The Constitution protects us from the government. An employer is not the government.

And depending on the contract an employer has great sway in their treatment of an employee. One fellow pointed out that Romney did not hesitate to fire a staffer that said in public that Obamacare was nothing but Romneycare with a new name and no one though it odd when he did.

One thing they all had in common was that none of them had ever seen the show. This, I thought, was really a plus in the discussion as none of them knew the principals and had no bias in the matter.

Synopsis: the guy exercised free speech, while A&E exercised free enterprise.

The financial impact may (or may not) be material - however, it has exposed a racist and homophobe and his tv time from here on will likely be limited (maybe to fox news).

Yup, I also hope that A&E loses a ton of money. If you're super rich like Oprah, you can say anything you want. So, I guess it all depends if you own the TV station or not.
