Balance shaft settlement

The next hearing is scheduled for August 17th. If the court approves the deal MB will pay a percentage of the repair cost. The warranty is for ten years and 125,000 miles.

Good news

Good news to an extent, some dealers are covering the job now if you are the original owner and are under 100k miles.
I am at 80k so far so good, no problems yet on my 06 which is in the bad serial number range.

Got letter today

Got letter today it covers all 272-273 engines 2005-2007
4 yrs to 8 yrs 50k miles to 80k miles will cover 70%
8 to 10 yrs over 80k under 125k they will cover 37.5%
over 10 yrs or 125k they will cover 0%
Most cars in the 05 to 07 range are over 80k and the 05's are already at 10 yrs so they are off the hook for the most part. But they will have to go back and reimburse the people who have already had the repairs done that were not covered.
My ML 350 is in the sn range and has 84k so if it went right now they would cover about 37.5% which is $2,250 of a $6,000 repair bill on a vehicle only worth $14,000 ............I am not sure if I would just do the repair myself or just pay the aprox $3750???????????????

Thought I would interject this release:

Law360, New York (March 24, 2015, 3:07 PM ET) -- Plaintiffs suing Mercedes-Benz USA over allegedly defective engine parts have agreed to an unopposed deal that offers putative class members the potential to receive thousands of dollars in reimbursements to repair their vehicles, according to documents filed Monday in California federal court.
The accord stipulates that Mercedes will reimburse putative class members for repair costs they incurred to replace the allegedly defective engines and will cover future repairs on the parts at issue for the lesser of either 10 years or 125,000 miles. If the repair was not done at an authorized Mercedes-Benz dealer, class members will be reimbursed the actual amount paid or $4,000, whichever is less.

My dealer doesn't have the sliding scale in their literature on the warranty. Just the 10 years/125k miles which ever comes first.

Validity of warranty is usually determined by the delivery date.
