I understand everyones right to object to unreasonable stops and/or searches but let me tell you what I learned as a long haired teenager and early 20s driver in the 60s. You can state and act on your rights but the cop has the untimate control of the situation. He can impound your vehicle and take you to jail for 24 hours if you make him mad. You might "look like a wanted suspect in some crime" or some other made up excuse but the bottom line is you're going to jail. What I learned is that unless you're willing to do the time and inconvenience, just go along and you'll be on your way shortly. You can then call your lawyer or whatever.

The mesh in the gas tank sounds like a good idea to me.

Concur. And I wasn't a long haired teenager driver in the 60s.

I don't know if it's available someplace or not, I've never looked. There probably isn't a market, because any serious off-road equipment uses diesel. I don't think I'll be putting much effort into recovering my $2/year and I'm not old enough to own a snow blower.

Aside from that, anyone who is evading taxes by using illegal fuel is certainly a sleaze-ball, and should be fined severely.

I dont know the law in texas so I can not comment there, In Pa(a few years ago it was tested) there is the complied consent law. If you have a drivers license(a privlidge-sorry for the spelling) you subject your self to unwarrented searches by law enforcement in the name of "SAFETY". Also if you are asked to submit to a field sobriety test and refuse you are automatticly guilty. I will try to find the law so I can post is. It is on the top portion of the DL (the part you tear off imagine that) that by signing this document you are agreeing to pa law blah blah blah. I dont know what the outcome was though...................

It was a farmer that was driving his tractor across a public road to access his other field. Tractor got dipped and guess what it had red fuel in it. It was a pretty big deal up in the wiliamsport area. The farmer closed the road to through traffic, His family had allowed access to then revoked it. It was a good story to follow about government abuses.

lol, this thread is funny. Whats the reason vstech is carrying a chambered handgun? Is it job related or choice related?

You guys are forgetting the order of things the cop did. I doubt at all that the cop pulled the car over because it was a diesel. Maybe it was a wisp of smoke, or slightly louder, or something about the car that attracted his attention. Ive been pulled over because the cop noticed I had a low tire for petes sake.
He approaches the car, the driver stares at him all the way up to the window as vstech stated, then turns out to be carrying a loaded handgun!
Yes, he has a permit, but now the cop is interested.

If I were the cop, I would certainly have done the same thing, taken the gun, run the numbers.

Maybe in the cop car as he checks out the gun, he also runs the plates and then he then notices its a diesel, so decides since he's there hes gonna dip the tank. I think the wild card here is the handgun, that made the whole thing change from routine stop for one reason or another to a potentially dangerous situation for the cop. I bet you that the handgun specifically made the cop think about looking harder at the car, not the cop pulled him over because it was a diesel.

I find nothing exceptional about this situation, If I owned a gun, and carried it like that, I would expect it to be run by the police, and vstech did the right thing by immediately stating he had one in the car and that it was loaded.

(yes yes, and all you pro handgun people calm down, there is no disputing that an armed motorist represents a potential danger to the police officer and other people. With that fact, he has every right in the world to run the handgun serial number.)

What ever happened to common sense? It seems like once you start a job with the government or get into the court or legal system, you enter a world where common sense does not exist.

I was once pulled over by a friendly local boro cop. He followed me for a while and then pulled me over. He said I had a tail light out, which I did. He revealed during our conversation that he wanted to get a closer look at my car because he liked it and does not see many like it on the road. He checked all of my paperwork, which was in order, and asked if I had any weapons in the trunk. I told him, "No, I don't" and gave him an innocent smile and kind of chuckled. It occurred to me later that I was glad I did not have my spud guns in the trunk. They have barrels of about 3 feet and are technically illegal. I am guessing they would have been confiscated and I may have had to pay a fine.

I see your point about the gun. But I got pulled for expired tags (they just changed how we do it in NC and now I don't get my nice reminder in the mail) I handed the cop my license and permit and he never even asked to see my gun. This was in Mt Airy and maybe our boys are a little more used to it. Around here, if you are unarmed, its rare. women have 38's and men have 9's and 40's and old men have 45's.

In the end I believe that revenue is the key driver here. My cousin was driving his diesel truck and he got pulled to check the left tank and unfortunately for him, it was his farm truck, and had bad stuff in there. So he paid the fine.

Not the first nor the last time this will happen. Oil in the crankcase and diesel in the tank. You'll be fine.

Never will I let a cop search my car without a warrant or probable cause. Just because he makes 35k a year and has a badge does not give him the right to snoop through my crap. By letting them search your car you are opening yourself up to victimization. They have their rights and you do yours. If you feel uncomfortable about the situation request his superior on the scene. By law they have to comply. Everything is video taped these days, and when tapes are conveniently lost these days it is not overlooked by a jury. Letting them screw with you is empowering a facist police state. They have their jobs and usually do them well and efficiently. Don't let the bad apples reign.
