Buying/selling vs giving away R12 freon

The Refrigerant Sales Restriction | Ozone Layer Protection - Regulatory Programs | US EPA talks about restrictions on buying and selling refrigerants. No mention of giving it away. Hypothetically, is it legal to give someone (who is not 609 certified) say a 30 lb tank of R12?

highly, highly doubtful. otherwise people could just sell pencils to each other for $30 a piece and then give a can of R12 as a "free gift"

Yeah, that covers sale and purchase. Nothing about transfer of ownership aka gifting. The only way I could see it being illegal to gift it to someone without a 609 cert would be if R12 was illegal to possess without a 609 cert. It's not explicitly illegal to possess it without, so it should be OK.

If it were illegal to give to someone without a cert, you would be in trouble every time you sold a car with a charge of R-12. Which brings things back to the old "container" absurdity of refrigerants. It's illegal to vent R-134 to the atmosphere from a "container" comprised of an auto A/C system but if you buy it in a can packaged in a container labeled as a keyboard duster, it's completely legal.

You're overthinking the situation...just don't have any paperwork.

For $25 bucks and around 2 hours, you can get your license, so it's really not worth the risk IMO. Why risk it?

Nor does it cover bartering R12 for something other than cash?

but regular people understand the test is just a way to make sure that at least at one point in time... that person knew what the rules were...
