And oh yea I got pulled over to. But over all it was good.
Will, upon some research, it seems to me your fix-it ticket is invalid, and the officer had no reasonable suspicion/probable cause to pull you over, nor frisk you (The classic Terry stop, though it is unclear that the case definitively applies to a traffic stop, but most courts treat it as applying).

I do not read the code to require 3 stoplamps, only two on later manufactured vehicles per Cal Veh Code:

24603. Every motor vehicle which is not in combination with any other vehicle and every vehicle at the end of a combination of vehicles shall at all times be equipped with stoplamps mounted on the rear as follows:

(a) Every such vehicle shall be equipped with one or more stoplamps.

(b) Every such vehicle, other than a motorcycle, manufactured and first registered on or after January 1, 1958, shall be equipped with two stoplamps,

and section (h) reads:

(g) Any vehicle may be equipped with supplemental stoplamps mounted to the rear of the rearmost portion of the driver's seat in its rearmost position in addition to the lamps required to be mounted on the rear of the vehicle. Supplemental stoplamps installed after January 1, 1979, shall be red in color and mounted not lower than 15 inches above the roadway. The supplemental stoplamp on that side of a vehicle toward which a turn will be made may flash as part of the supplemental turn signal lamp.

A supplemental stoplamp may be mounted inside the rear window of a vehicle, if it is mounted at the centerline of the vehicle and is constructed and mounted so as to prevent any light, other than a monitorial indicator emitted from the device, either direct or reflected, from being visible to the driver.

Note the word MAY not SHALL

So as I would interpret it, the 3rd brake light may be installed and it is not REQUIRED therefore I do not see how the following applies:

Lighting Equipment Requirements

24252. (a) All lighting equipment of a required type installed on a vehicle shall at all times be maintained in good working order. Lamps shall be equipped with bulbs of the correct voltage rating corresponding to the nominal voltage at the lamp socket.

Note the words, REQUIRED TYPE. Again 3rd brake light is not required.

As far as the frisk, I also would argue that he had no reasonable suspicion to believe, nor articulable facts to support such a believe that a crime was occuring/about to occur and that you were armed and dangerous. However, you damages may be minimal.

Again, the probable cause/reasonable suspicion standard to pull you over is absent in your case, therefore the rest is fruits of the poisonous tree, exclusionary rule applies.

There you go, free legal advice; remember, you get what you pay for.

Any other attorneys should weigh in and fill in any deficiencies in my short analysis.

I would argue it is unreasonable for an officer not to understand/know a law he is attempting to enforce.

But what do I know, the Gov't is always right and all powerful.

Unfortunately, the Constitution gets in the way sometimes for them.

The truth and we all know it

The meet was great and all, but honestly, at the end of the day, I had a hard time justifying driving all that way. Yea the meet was great, but the best part for me was cruising down 80 at 80mph, with the seat pushed back, cruise control, and a good smooth playlist, with the engine of my 300d roaring through the night. Alone. Me and my car.

And then theres garret. Who knows if it was intentional, an accident, or just plain the cap coming off on its own. But I feel for garret, there is nothing worse that can happen at a meet, aside from a wreck. Tomorrow morning he is going to see if it is bushed or not. Garret, if the engine is still good then ill give you a brand new hood pad I have in my garage for free. Hope that makes you feel better...

Only about 20 cars actually showed up, instead of the anticipated 37. It just seemed.....without enthusiasm. And who told nick to go so slow?

Atleast me, greasil, and nick kicked ass on a few of the windy roads. Also luvlaw was on it occasionally. At one point I had to show off the fact that my car has a turbocharger and pass greasil illegaly on an uphill. Probably the funnest event of the day.
And I wanted to drag race some diesels bad. Oh well.

Thats basicaly the breakdown. This was my first meet, so maybe there all like that. But regardless, I am happy that I went. I now have faces instead of just screen names.

Not to mention the weather was crap

EDIT*

Bullcrap. The meet was WELL worth my time. The more I remember the more I like it. Cant wait for the next one. I guess im just happy because my day went smooth

Just got home and had a really good time. It was a lot of driving today (but I know others did more), but all in all a blast. We meet, drove, ate, drove, then hit up pick and pull. I got a ton of pictures.

Garrett, those that stayed said they didn't touch your car, so I'm not sure. Hopefully it will be alright.

Pictures later. Oh yea, got a new signature picture coming up.

I was glad I was there at the last drive, But now I am wishing I was there today!

Looking at Garret's pics, looks like a great meet!

Sorry to hear what happened Garret. I guess the lesson here is that in any type of meet, check and make sure everything is in order before heading out. There are a lot of people checking out your car (even people not involve in the meet) and anything can be out of place.

I had a great time too even though I wasn't in my MB. I did finally get to see where my BOV pressure was set to.....20psi I think Zack experienced that.

Garrett, man that sucks. I did the same thing to my 240D but it was only for a block and a half and my hood pad will never look the same.

I'll post some pictures somwhere and I have a cool 30 second 90mb video of all of the cars from Smothers in route to the Cheese Castle place for lunch.

I had a great time seeing the sights and meeting old friends and many new ones. I hope to see you all at the next gathering.

....meet at greasil's the next time? I hope there's plenty of parking

I have been looking for an excuse to pack the street like my neighbors do when they have a party, I am sure I could reserve the whole court for us to park on then we could go for a drive come back and partay!!!

I also just figure Martinez is sort of central to all of us in the Bay area, but I am down for a SacDOtOmato Drive as well.

I just want to play again.....

Can you tell I don't get out much??

Didn't get in to 5:30am this morning and 458 miles more on the car

Great fun!!! Wonderful to reconnect with old friends not seen for a long time,
and to make new ones!

Thanks to all who made it such a success!

Probably around 20 cars made it! Buzz ("Dieselchatter") and Charlie ("Charlies84380SE") came all the way from Los Angeles to be with us...

I was glad to help setting up the event, and look forward to another...

For me THIS is the REAL Mercedes Benz exprience, NOT standing in the Dealer's showroom. talking with other customers about my tennis game and how I got hammered in the Stock Market and reading the Wall Street journal while drinking the Dealer's cappuchino and nibbling their excellent biscotti

Thanks to everyone who came and who helped organize the event!!

Another great meet!

Another great NorCal meet, for the most part. Sorry I had to split early (the historical society's lunch was not as much fun) and sorry to hear about the damage to Garret's ride. Hope it is fixable. Great pictures, I'll make sure that Smothers sees them.

The Peninsula this summer sounds like a good idea, then maybe back to Sacto this fall?

Thank you Dee8go. The old W123er and W126er Mercedes certainly do clean up amazingly well.

This '84 300SD in the next picture below is really amazing. It has DUAL exhausts. Each of them is made from a steel CYCLONE FENCE POST! It has to be seen and heard to be believed. This car will NEVER need to go to a muffler shop ever again.

Look carefully at those foglights on it: they are from an SEC!!!

The owner, Nik, is shown with the car. He is getting ASE certifications. Meet the NEW generation of Mercedes Benz mechanics!!
