ML55 safetey recall ?

I would like to know if there's a safety recall for 02 ML55 regarding the following issue:

One of the two steel brake fluid lines coming out of the master cylinder has been rubbing with the fuel line. That is how the fuel line has been since the day it was purchased. ML has about 75K miles now. Yesterday, I noticed that the brakes werent working. Pedal going to the floor. I openened the hood and was shocked to see that the constant rubbinng of the steel braded fuel pipe with the brake fluid line made a hole in the brake fluid line causing brake fluid to leak and drop on the engine causing smoke and burning.
The fuel line is also half way towards leaking due to the constant rub.
To me this is just unacceptable and a major safety hazard.

Given that the ML is out of warranty, is this something mercedes should recognize as a safety issue and fix the brake line and fuel pipe for free ? Is there a prior safety recall for this ?
