Help Me Understand
I am getting really frustrated with the legal system, it all boils down to something I cannot understand. Although "Deep Pockets" is what I blame it on.
Here in Chicago, an office fire downtown last year, the FIRE DEPT is being sued because their rescue plan was not effective. They were there attempting to rescue, how can these lawyers and courts blame them. A porch collapses and kills several, the city is being sued because they didn't inspect it. It was built illegally, how can these lawyers and courts blame them. There are so many more. I just don't understand

Well, filing suit is one thing. Winning a law suit is another story...Watch these suits and see what happens. I'm not familiar with the details, but these cases are rarely bank robberies.

If you get a chance go pick up "The case against lawyers." Written by a lawyer.

Well actually the city is suing back some of the people on the porch as they were supposedly jumping up and down. I don't think that is right either, although these were college educated (I believe most had already 4 yr degrees). They hould have known that 30 people on a "Properly" built porch that size was too much. Note, from what I have seen it wasn't built far off code.
The owner and or builder have the responsibility. But because of corps etc they have limited liablility. BUT THE CITY HAS DEEP POCKETS. FYI They don't need to win, they will all walk away with $, (lawyers MOST), it's call cost of defense.

What type of rescue plan are you referring to? If the Fire Marshal signs off on the fire plan you bet your but he's liable and developers pay big bucks to municipalities for this stuff. I have a friend that just paid a city gov. over $5K to approve a handicap plan, it the city wants to play architect and accept the fee's they better be willing to pay up. What were really witnessing here is an issue that is springing up all over, city gov's are playing around in the private market place and when someone gets burned they try to dodge the bullet. This used to be the architects job. |

Blame it on "settlements" and the existence of insurance. Most of these types of lawsuits are brought with the primary goal of having the case settle on the proverbial "courthouse steps." The business decision of weighing the risk and exposures by both sides usually drives the parties to reach an economic settlement. Remember that perhaps 90% of all civil actions never go to trial, but are resolved through dismissal or settlement and it's not hard to see why. The plaintiffs don't have any money invested in the case and generally aren't liable for the other side's attorney fees if they lose, unless there are specific provisions for that payment. So, what do they have to lose?
