Judge in Spain orders 3 GIs arrested

Why the US wants no part of the International Criminal Court, no part of Kyoto, and no foreign law influence on our legal system.

http://www.chron.com/cs/CDA/ssistory.mpl/world/3404601

MADRID, SPAIN - A judge has issued an international arrest warrant for three U.S. soldiers whose tank fired on a Baghdad hotel during the Iraq war, killing a Spanish journalist and a Ukrainian cameraman, a court official said Wednesday.

so youre saying the US soldiers should face no criminal actions for any misdeeds in a war situation? even firing on a hotle full of civilians and killing three of them?

how about rape? murder? human rights abuses?

Spain has to be able to extradite the 3 GI's to Spain. Good luck on that. No US Court, except maybe the 9th Circuit, would ever allow that.

Nice leap to a wrong conclusion.

The point is a foreign court expressing jurisdiction over US citizens.

The US military and the US government is responsible for punishing war crimes commited by its soldiers.

Background here where Belgium tried the same thing and backed down when Secretary of Defense Rumsfeld threatened to remove NATO headquarters from Brussels.

How about if any one of these soldiers wants to vacation in Spain or any EU country for that matter?

I agree -- this is just silly. They might have a leg to stand on had an incident actually occurred on Spanish soil.

The article states that the US soldiers were being fired upon from the hotel. Although it is possible, I seriously doubt that US Army soldiers would purposly target and kill foreign journalists without a legal reason to do so (i.e. within the rules of engagement). Of course, in war, if you are to the point of being fired upon it is immaterial who it is that's doing the firing - your job is to stop it.

I agree with you 100% ...someone is shooting at me from a hotel, I'm not going to the front desk ans ask them who resides in roon # such and such....if its terrorists or if its journalists....

You run to a war zone....you risk being shot.....every clown who goes there knows that.

Doesn't appear to be anything official yet. No doubt their careers are probably at a dead end.

Here is a pretty detailed account of that day:

poorly worded riposte.

if the soldeirs comitted a crime in any country, that country has jurisdiction over them. period. so, just like that kid who was keying cars in singapore was sentenced to be caned, these soldiers are subject to the laws of that land.
