One more thing, I think that you are getting MBCA (Mercedes Benz Club of America) and MBUSA (Mercedes Benz of USA) mixed up.

The former is a club made of up of Benz fans, the latter is the licensed distributor of Benz cars in the USA.

The "reasonable fear for his or her safety" probably isn't an issue here. I don't think anyone has made any threats against the person or his family. They just want him fired.

"Reasonable fear" is defined from the perspective of the person being harassed.

I have no desire to argue whether any of the acts and/or conduct described here arise to the level of stalking.

I am merely pointing out the possiblity that, depending how one looks at it, there is the potential that someone could be walking into big legal trouble.

The question, at least for me, is whether any "fun" derived from teaching a lesson to someone, who may not even get it, is worth the potential hassles.

That is a question that each person must answer on his or her own.

I do understand your point. I am in no position to argue that the acts performed would not be perceived as threatening, as I was not a party to any of them. The descriptions seem harmless enough to me, but as you imply, my opinion of the descriptions of the actions is meaningless.

I wouldn't even make such calls in the first place. But if I got such a response from a dealer in a voice mail, I would seriously consider forwarding it to the mother ship. I probably would do so.

I called and the secretary said he was on vacation all week. She did offer to transfer me to his voicemail so I left a nice message for him.

Notice the bold text.

Calling Mr. Lire on the telephone and asking if he can provide some info on an e-class vehicle.......and then commenting that "or should I just shove it up my ass".........will not fulfill the intent of the statue. There is no possibility that he can prove reasonable fear for his safety.

well. our point is not that he harrased me, it's the horrible way he represents mercedes. I'm not looking for a harrassment suit, I just want the moron fired, repremanded, or at least, to let everyone in NJ know that this is not a company we want to do business with. He thumbed his nose at Us, MBUSA and Benzworld and tells us he doesn't want our business? If he thinks he can survive on sales from people who have NEVER owned a mercedes, he is sadly mistaken. He must learn that the Loyal owners, who buy time and time again, (and some of us own 5 and 6 MB's at the same time), will not tolerate such an attitude from a Mercedes dealer.
I call for a Boycott!
