Grapir gets it! I could not care less what their motivation was. I was made more than "whole" and I am very happy with the result.

Incidentally, the actual "crunch", the impact, took place at low speed so there was no physical trauma to me at all and I was not into playing out any PI charade.

HuskyMan, the insurance company was State Farm. Apparently they have mended their ways as years ago they had a reputation for being pretty miserable to deal with.

don't be so quick to sign off on the "low speed impact" = "no injuries" idea. I've been spending some time with knowledgeable orthopods/chiros who know how to read MRI/CTs/Xrays post low speed impact trauma. today, you might feel 100%, in 10 years you may begin to feel the results of "low speed impact", especially to the upper cervical area. good luck.

The term "low speed" is vague. Is it the speed of the striking vehicle at impact on the target that is important or is it the "change in velocity" that the human body experiences?

As for any onset pain 10 years down the road . . it would be hard to establish the etiology of those symptoms to an event that far back, as opposed to the effects of merely living those 10 years.

I was thrown out of a T-boned car when I was 20. Never thought about it for many years.

Fast forward 37 years, and my spondylolisthesis is being blamed on an impact to the lower spine. I can't think of anything that impacted my spine in the intervening years, except the car accident. Last year I had major surgery to treat it, and am still experiencing very significant pain and weakness.

Don't want to scare anyone, but it's funny how these things come back to bite you.

I'm wondering if there were any ISSUES with her?
Was she fully licensed to be driving?
Was she under "Doctors' care" and taking anything for it?

I was t-boned 14 years ago. Driver blew a 0.16 at 2 in the afternoon. He didn't even have a state DL. AAMOF, the license he presented was another state's license, expired over 3 years before.

But,

He had insurance. He was completely covered. I didn't go "attorney hunting" or anything on that order. My vehicle got fixed (and it was even better than before the crash) to the tune of $6,000+ and I got a separate check for $7,500. His insurance company also paid the hospital (I went and got checked out to be sure nothing else was weird or hinky), they paid for the rental car while my vehicle was in the shop and until I picked it up and I never had to fork out anything from my pocket, expense-wise.

The one dig I gave them (his Insurance Company) AFTER I picked up the $7.5K check was this - I asked the agent (he was at the office with a few fellow agents in the same room) "How come someone can have car insurance, to the level this guy did, and not even be a licensed driver?"

You could have heard a pin drop as I walked out the front door.

BTW, this was a State Farm office.

My rates never wiggled.

And, I never did get an answer.

This is an interesting and all too possible angle.

As for to OP, glad you weren't injured and received what you feel is just. In your case that is what really matters. But, as the saying goes, the exception proves the rule. For every case that ends with a result such as yours, there's hundreds probably thousands of cases that live and die on the other end of the spectrum. The underlying details that may exist with the offending driver are in my opinion most likely what drove the ins. company's actions in this case. I'd bet on it.

I would hate to see an actual scan of my back after the multitude of wrecks I've been in. I deal with the pain everyday. And no amount of money, let alone the measly pittance I've managed to receive, will get me back near 100%. The ins. co. racket is in dire need of an overhaul. Instead of its' true purpose, it only serves as a catalyst to shuffle wealth from one groups' pockets to another.
