Garage burglary

!@#$%&^&!! Someone broke into my garage last night and stole a bunch of stuff. My new upright compressor, a couple of compound mitre saws and the brand new winch and tray for the camper truck. It's a good thing I didn't catch them in the act because I would have been tempted to exercise my rights under our Make My Day law.

Not sure what they did to the lock. I had a hardened padlock and a keyed latch on the door. Padlock is nowhere to be found. Pryed the door open and busted out the screws holding the keyed latch.
I'm thinking they must have been disturbed during the process because I had two other compressors, a brand new gas powered impact wrench, and a Lectro truck dolly along with 2 mopeds that they left behind.

Err change what you just wrote - you never know if the thieving little &^$&^$(*s have got internet access - you don't want them coming back!

Garages are difficult to secure. I've often thought about fitting a cage inside the garage just to slow them down a bit. I think in real terms that is best you can hope to do - slow them down for the make my day punk scenario...

Not really. But it would have been wise to control my actions since from a legal point of view, I have my doubts as to whether a garage constitutes a 'dwelling'.

Ask the advice of the officer when they come to document the theft/burglary report.

Well I guess the only thing to do now is make something like this preventable in the future.

May be there's a clause that if you spend enough time in there it becomes a dwelling...

I'd give it a shot as a legal defense. Pretty strong precedent in CO. Guy came to someone's house and roughed up someone inside the house. Perpetrator left and was getting into his car on the street. Homeowner shot him dead from the front porch. Wasn't prosecuted.

Was the garage insured against theft?
