With the way many "city" "streets" in the US are misdesigned, there may not have been a marked crosswalk within a mile. Comparing jaywalking to shoplifting is at best boneheaded.

Stupid laws are meant to be ignored. Shame she didn't have a jury trial. Any sane member of the jury would have given that prostitutor the "vaffanculo" and refused to convict.

30 year old with 3 kids. From the picture I thought she looked younger.

The cruel thing to say is Darwinism. Was she capable of effectively taking care of 3 children if she has to cart them around on public transportation? Father obviously isn't in the picture, mom is not working, money comes from everybody else. This kid's future in that situation wasn't that bright statistically speaking. Its a tragedy for sure, and could happen to any parent, but you can see the demographics of the situation and understand how prosecutors can twist things to pursue legal action.

My mother wouldn't let us cross the street in our neighborhood when we were that young without holding our hands. It is extremely negligent not to have a firm grasp on your kids when crossing a busy street. Hindsight is always 20/20, but a stroller for 2 with the oldest glued to mom's side would have prevented all this. Was that criminally negligent? Who knows. If this woman was white would any of this media hoopla taken place? Not likely.

The problem is saying this without being labeled as racist. Around here we have an epidemic of white women leaving their kids in the car while they dash into the store for something. Seems to make the news pretty regularly.

Study up mr bonehead caller- the nearest crosswalk was 3/10ths of a mile away.

Um, you've just insulted 75% of my neighbors with kids, who don't own cars. Since when is owning a car a prerequisite to being a good parent?

Right, and the kid ran away from her. Should she NOT have followed the kid just because there was no marked crosswalk.

Fascist views like yours are why my family left Eastern Europe. Looks like the pendulum is swinging in the other direction these days.

Proper application of justice involves compassion. Clearly the prosecutor is a psychopath with no empathy, for attempting to further punish a woman who just lost a child.

I don't know you, but speaking of the prosecutor: kicking a person who's already been punished in one of the worst possible ways is cruel and low. I'm not anti-society. I'm against "zero tolerance" policies and thoughtless application of the law.

I'm against inflexibly applied rules and restrictions, as well as the American concept of keeping ~1% of their population in "the system." The woman was already hurt in the worst way, and her case could have served as an example to other parents. No need to go beyond the pale and put her on trial as well.

And yeah, a little bit more anarchy and chaos would be a good thing for the US. Seems like the place has lost its sense of humour and proportion in the last 30 years, and especially since 9/11. Oddly enough, it's actually worse outside of NYC than in the city, where many laws tend to be honored more in the breach than in the observance (Giuliani almost got laughed out of Gracie Mansion for his jaywalking campaign).

Nothing like a good Federal (followed by multi state) bankruptcy to cut the system down to a more manageable size.

From the article:

Five weeks after the accident, investigators came to Nelson's home, said her aunt, Loretta Williams. Nelson was charged with three misdemeanors: second-degree vehicular homicide, failing to cross at a crosswalk and reckless conduct, according to court records.

A jury convicted her this month. Although prosecutors did not recommend jail time, each count carried a potential sentence of one year in jail -- for a total of 36 months.



Seems like maybe the judge went easier on her. The jury said guilty.
