Indiana has a ban on teen drivers using cellphones or texting while driving. I haven't heard of anyone that has been ticketed. I do think its a problem even for 'mature' drivers. I think there is a ban on Over the Road Truck drivers texting or possibly using cell phones. I haven't heard again of any one loosing their CL license. I hope Nevada does better.
I do wonder in case of an accident, if cell phone use would be grounds for a civil lawsuite. In Germany, if your in an accident and don't have a seatbelty on, it your fault. Also, they yank your license for hitting a bicyclist or first DUI. To a large extend, I do think that it depends on situations. About 15 years ago, a kid was killed riding his bike. From the story I heard, he darted out into the road. No way the driver could react, and the kid was in the wrong. I think the parents told the driver it wasn't his fault. Also, I don't have a problem with hands free devices, for adults.

I for one am in favor of this. Of course I live in California where it's already illegal and every time I drive somewhere I STILL see people with the phone to their ear (or texting).

A judge also recently ruled that "no device in-hand use while driving" includes being stopped at a red light. His attorney has said they will appeal that to the state supreme court. Yes, that's a burning issue that must be pursued, the right to talk and text while at a red light!

To me this is really easy. If you have to talk and can't afford a headset, pull over. And if the text is that important, pull over and read/send, then get back on the road. If your life is so busy you can't do that, then you need to cut back, period, before you cut someone's life short.

I think that's because it's only a $20 ticket for the first strike and $50 on subsequent offenses. Not enough to be a deterrent. In Nevada it's going to be $50 the first time, $100 the second, and $250 for third and subsequent.

I agree. I sometimes wonder what people are yapping about that they think is important enough to justify endangering themselves and everyone around them.

That's an excellent point. Personally I'd be in favor of a change: when it is directly observed by the officer, the cellular phone is confiscated as the fine and penalty. THAT would be an actual deterrent.

I like that idea. For me, not having my phone would be a minor annoyance, but the kind of people who would be subject to this penalty would probably take it as a major hardship.

I don't know the laws in CA. Also, what a Judge would rule. Also, what precidents have been set. In Indiana, I think it is intent to operate a vehicle. Mainly concerned with DUI. I think its once the key is in the ingnition. Also, I'd argue, that while at a complete stop, the operator would need to have the ability to move in case of impeding an emergency vehicle.

60/70's VW drivers graduated to Volvos, now they are getting on they have moved on to a Toyota.
Over here they are known as "grey nomads", a landcruser with a caravan in tow. They are probably just off a heart attack or a stroke. Blind as a bat & deaf as. Determined to spend every cent they have so the kids dont get an inheritance. The dementure has set in enough so they dont remember they are towing anything.
