Some punk kid punched the hood of my 780 Berton

So, I just got my Bertone back after my neighbor back into it. It was a nice day, I was driving down by a school where their was a ball game in a school. I slowed down to the required school zone of 20 mph. I had this honda civic roar up behind me and start honking and the driver was fliping me off. I ignored it. This went on for several blocks until I came upon the left turn lane to get off on the road I was going to. Then the honking re-sumed and the passenger got out and punched the hood of the car. I called the police with their plate number and they said they will look into it. I may not get blood out of a turn up. So, If I'm stuck out of pocket with good driving record, should I turned this creased hood into them for comprehensive, or just pay out of my own pocket, really don't wan't to as the hood could cost $500 alone, and that is not including paint work. However, I don't want this to be a temporary loan from the insurance company. I have never made a claim before, so any advice would be welcome.

Man, that really sucks!

You have the license number, contact DMV directly and tell them. If you were in the car you probably have a civil claim against this POS for assault. I would also contact the district attorney and have them press a criminal case, this kid is on a bad road and needs help before he hurts or kills someone.

Leave the crease alone for now.

I don't disagree with pressing charges.

If you turn it into your insurance company they will pursue the matter with the DB's insurance company. If he is uninsured it should be covered under comprehensive since you were not driving when it occurred. A comp claim will not impact your rates I don't think.

I always carry five hundred deductable on collision and one hundred deductable on comp. the lower deductable on comp is almost free and the larger one on collision really saves some money.

Get hold of his insurance company if any. Your insurance company can find out who they are. Police can get the information as well. His liability is for damages he does to other cars.

I am a pretty easy going older guy in general. That said he was very lucky he did not try a stunt like this on me. I have dealt with one episode years ago not totally simular. The individual was very sorry he initiated it.

you may wish to contact an injury lawyer and relate the scenario to them. Ask them if they think filing a police report and a report with the district
attorney would be beneficial. This is another instance where a
video camera record of the event would be VERY useful.

Update...So, I was finally able to make a police report. The officer said that their was not a whole lot to stand on if the driver denied anything. Well things went very well. He went to talk to the driver, and she admitted that her and her boyfreind were haveing problems and he he took it out on me. She also indicated that she would take full responbiity for the damage. However she is not going to have the money for a month. I'm not going to press criminal charges if she makes good on her promise, however, if she does not, I will be left with out a choice. Then once this gets fixed, I think I might just sell this car, as it seems to cause bad luck.

That sounds like a BS excuse to me. That whole situation never should have happened, so trying to be nice to one of the people who is responsible isn't going to get you anywhere.

sounded good until the month part. Since they confessed it might be a good idea to pursue the collection angle. I would suggest talking to your insurer to see what they say about it. Did the party have insurance? do you have a written report from the policeman who interviewed them? With a report from the officer I would think you would have a good shot working through your insurer and theirs. Small claims is an option too but collections of a judgement is always a potential issue.

I'd make the suggestion to them of paying up to avoid having the claim on their insurance.

Also there is the potential of charging them with assult, which this probably fits the definition of.

Auto insurance doesn't cover intentional acts and if the guy was a passenger, then it's even more unlikely that insurance would provide coverage for them.

No insurance per what MTI wrote...

Yeah, I think he's a schizophrenic. The UW students named him "Tunnel Bob" because he hung out in the steam tunnels under the Madison campus.

There's been a lot of discussion about this guy over the years: Tunnel Bob: Madison, WI

He punched my 560 door (stick it to the man kinda thing). I saw him do it, told him to sit still and called the cops. They arrived and told me wasn't usually violent (prob off his meds). I didn't press charges of course, but worked with his social worker on a payment plan. He paid me back.

You now know who he is--if hes a minor --GO AFTER the PARENTS HOMEOWNERS INSURANCE. They will make his life pleasant for a long while.
