My mind isn't made up at all -- I just think it's quite possible that he provoked Martin. Ultimately, it's up to the jury to weigh all of the facts.

My mind IS made up about the fact that the purpose of neighborhood watch should be to watch/report and not harass strangers. How would you like it if you moved into a new neighborhood and some creepy fat guy kept following you and asking intrusive questions when you just wanted to go home and take a leak?

In which case you would most certainly be the one charged with a crime- not the person who "annoyed" you. Your right to swing your fist ends where someone else's nose begins...

Unless you live in a third world country it's within someones rights to "annoy" people. It's not to physically assault and you would clearly in the wrong and would be charged.

You live in NYC - it's full of creepy fat guys and people who ask intrusive questions. It that harassment to you? It's not to the other 13 million NY'ers. Love to see you try that excuse to NY's finest: "Um, well, this creepy fat guy followed me and I was annoyed so I slugged him." See how far that'll get you. Sheesh.

If he said "get off my street n----- before I kill you", a jury would likely see my actions as justified. Or at least both of us would be held responsible. Look up "fighting words law."

You said "following and annoying". Following and pestering/annoying are not equal to "fighting words".

I understand the legal definition of fighting words are; "crazy ass cracker" would most likely qualify...

Not in FL it does not. If I (Martin) feel threatened by you (Fisherman) I may defend my self with any means including deadly force since I do not have the duty to retreat. Now it would be up to a jury if it got that far to determine if my fear was reasonable or not. The stand your ground law in FL is quite far reaching. May members of law enforcement and prosecutors do not like the law.
