Come to think about it, I think dad had an Obrez pistol made out of a Mosin. I distinctly remember him having a cut down bolt action pistol, that he didn't have a bolt for. It was a war time souvenir that had for as long as I can remember. He didn't talk about it much, other than to say that he didn't have the bolt.

I'm going to look for it when I visit mom after Christmas in a few weeks. If it's what I think it is, I'll be bringing it back home with me.

Ive seen those plastic stocks and they're actually pretty decent. Also there are plenty of cheap genuine wooden stocks to be had.

I've noticed an increase in wooden stocks being for sale in the $40 range. For another $20-$30, the plastic ones can be had, or you can find another Mosin, depending on where you shop. LOL

I did some research today. If what I believe to be an Obrez is true, it's going to have to be handed over to the ATF. According to everything I've read, they aren't legal unless the receiver is new, which they can't be found, or is a repaired one with proper taxes paid. That's a shame, too...because Dad brought it back as a war souvenir from Vietnam, but didn't get proper papers on it. I'm torn on the subject, because it was my Dad's...but I don't want something in my possession that could get me in trouble.

I'll find out more at the end of the month.

What are they going to do to you? I have to think if your dad brought it back from nam it would be grandfathered in. Was it legal when he brought it back? If it was surely it would be legal now.

No...If it has parts that were originally on a rifle, it can't be used on a pistol. That's why he didn't have proper paper work on it...because it wouldn't pass. Since there's no proper paperwork, transferring ownership as a NFA would be damned near impossible.

It's possible that I could send it in to them for consideration for classification under 478.11 section C
Quote:
"Any other firearms which derive a substantial part of their monetary value from the fact that they are novel, rare, bizarre, or because of their association with some historical figure, period, or event."

And from the BATFE's guide:
Quote:
Please note that firearms regulated under the National Firearms Act (NFA) may be classified as C&R items, but still may be subject to the provisions of the NFA. If your C&R item is an NFA firearm (e.g., Winchester Trappers) and you desire removal from the NFA status, you must submit it to FTB for evaluation and a formal classification.
Quote:
Sending it to the FTB risks destruction of the firearm, as they may feel compelled to de-mil it. At that point, I could file the proper paperwork, pay for the tax stamp, have the receiver welded and get it back into working order.

The law is screwed up here...it's NOT a machine gun, it's a bolt action rifle. However, since the receiver was attached to a rifle barrel at some point in it's life, it become a rifle...one a rifle, always a rifle is the ATF stance.

Do we still have our resident lawyers present, or were they all ran off?? I'd love to hear them weigh in on this. I've also posed these questions to another lawyer friend of mine, for his opinion.

This picture is NOT of the firearm in question, but on like it.

There are cases where people have made them legally, paying the taxes and getting the proper paperwork in place. They are ugly as hell, and not that accurate, but make one hell of a boom!!
