And if they were only a summer intern it would have been worth it! What a score! Most news anchors treat interns worse than Saudi domestics.

It's reported the airline, ASIANA is to sue the TV company for this. ...as they think it is demeaning to the crew. I think the crew ought to be more concerned about the passengers suing them for jeopardizing their lives.
It is of little concern in the scheme of things that crew are mad at the TV station, considering two people lost their lives in this accident due the PiC and the Sic...flight deck crew. Unfortunately the names of many sound humorous in English, but in this instance the dark humour used in the TV report was inappropriate and repetition here would be too. I'm not seeing the value in a lawsuit. The airline claims a set of funny sounding prank names makes the airline look bad. While unprofessional and in poor taste, I don't think it has any effect on the reputation of the airline. You know what makes the airline look bad? Crashing a plane full of people on landing badly enough to knock the tail off and kill several people.

The airline must prove, in a court of law, that it was harmed financially by the TV clip. It must put a dollar value on the damages. Not very easy to do and convince a jury or a judge. |

So it matters what the jury thinks.

I didn't think the judge (in an American law system) could over rule the jury - so yes I think it does matter what the jury thinks.

In a civil suit, such as this, a judge may throw out or lower a verdict (remittitur) or increase a verdict award via additur. The affect party then has the right to a new trial if they wish to challenge the judge's actions. |

While "actual damages" could be nominal, the station's conduct may satisfy the test for exemplary/punitive damages, which would result in an award to "punish" rather than compensate. The punishment award can be based on the net worth of the broadcasting company.

Brian, I was not commenting on whether a party would be successful, just stating that outrageous conduct can result in a non-compensatory exemplary award. The standard is pretty high, as one may imagine, typically consisting of reckless behavior, to the extent that it "shocks the conscience" of the average person.
