Lawyer/Divorce Problem- Looking for Suggestions?

Hello,

I appreciate your time, I've not ever posted in here, but I figured there are a ton of smart folks here, so why not?

I am looking for ideas; I was divorced a couple of years back but unfortunately it isn't really final. I contracted a HS friend to be my lawyer, and while he certainly knows the law and made me an excellent deal with me over the cost, he has left me high-n-dry on winding this thing up. The matter has gone before the judge, and the finances have been decided, but it is really up to the lawyers to decide on what the judges decision looks like, And See That Through. Question- What should I do to wind this up, short of doing my own filing for contempt in court which is 800 miles away now? I have called, emailed, and texted my lawyer, begged, pleaded, been firm, been soft, and nothing has happened. The judge ruled in November 2013, but here we still are... I am not anxious to contact the Ex and ask for her help to push HER lawyer to finish this up, but I may have to; women have a stronger talent at being 'squeaky-wheels' than men do (no offense ladies). I am open to any idea, I NEED TO GET THIS DONE! Thanks for your help.

Simple...and not inexpensive on the face of it...replace your attorney with a better one.

I'm sorry, I should have added; I'm unemployed and broke.

Report your lawyer to the state disciplinary office to get him to respond. He is still the "attorney of record" if he made an appearance (filed documents for you or appeared in a hearing).

That makes things quite a bit more challenging.

I hesitate to suggest this, because the lawyer is your friend, but at the same time he's a drag on the profession. So if you've a mind to, you might write a letter to the Judge. Explain the situation. Be sure to send a copy of the letter (and note in your letter that you've done so) to both attorneys (hers and yours).

That might get the other counsel to step in and wrap things up (sounds like her attorney has been dragging his/her feet as well) and if nothing else it should be an answer to what sounds like contempt charges.

The other alternative is to contact the county court for the jurisdiction and ask if they have a roster of legal-aid type attorneys whom you may contact. If things are as "finalized" as you suggest, even if they can't help they may be able to refer you to an attorney who can help you to simply wrap it up on a pro bono basis. Attorneys are supposed to donate some of their time, and if this is that quick, it would be a perfect opportunity for one to jump in and help.

Good luck to you.

Both lawyers on mine did the same thing.
Resolution was simple.
Went to my lawyers office, got the paper work and filed it.
Ex got reeeally pissed off as it was apparent to the judge
what had been going on, so ... he back dated the degree
9 months.

Or the State Bar. They'll be interested, and he'll be interested in staying in their good graces.

fired a divorce lawyer .......

One of the most powerful things I did about 20 years ago was to fire my divorce lawyer. He and my ex wife's lawyer were in a letter writing campaign --- she said, she did; he said, he did --- blaming us and running up their billable hours.

I remember the morning I called about 11am and asked what my current bill was; that I was firing him, and I would be there at 3pm to pay the bill and pick up my file. The only thing the receptionist could say was, "please hold on, he will speak to you in just a minute". I thanked her for the job she was doing and said I didn't want to talk to him for even one minute; didn't want that added to my bill.

A friend of mine hired an advocate lawyer to help guild him through the process. This was in addition to his divorce lawyer. The advocate second guessed his wife's lawyer and told him what to expect and also worked with his divorce lawyer to move things along.

Why the divorce lawyer did not do all of this is unknown to me, but my friend was very happy he hired the advocate. It saved him a few million bucks during his divorce due to the advocate thinking up all the ways he could be screwed over by his wife and helping his divorce lawyer to head them off.

This may not be of much help to you, but someday someone else will read this thread and it might help them.
