The right to face one's accuser in American courts is a constitutional right.

So, if the person is a citizen then I think he should have his day in court. If he is an alien then his particular circumstances become important, don't you agree?

I don't get it. You don't have to be an American citizen to fight a court battle here.

I think the most accurate response is, "It depends." The court has to recognize the standing of the individual for a suit or pleading or claim to proceed. A citizen has certain standing automatically by virtue of citizenship. Non-citizens do not.

Any individual that has exactly the same rights and responsibilities as a citizen is called a, "citizen."

No they are not. The "Torture" guidelines are spelled out crystal clear. People watch too much TV good intelligence is not gathered by pulling fingernails or any other preconceived notion of torture .

I can back my claim how bout you?

The Court didn't refuse to hear it because of his citizenship though. They refused to hear it because the government said it would reveal secrets of natioanl security.

To me, torture is when I can't get what I want. Like unable to avoid pain or inhibiting my freedom. The spectrum is wide but that's where it starts. For me.

The degree to which torture is allowed or condoned or is culturally acceptable is directly related to it's definition.

I find that plausable. After all, you don't want others to hear certain things because it might tip them off.

Yep, its mutual, I am sure the other side relishes it as well, Hanoi Hilton comes to my mind, so the Germans and Japanese didn't hold the baton of torture I guess during WW-II. If you relish and condone torture, don't cry foul when the other side does the same with their captivesand knowing how devious and evil human mind is, it gets quite creative and gruesome for sure.
