Unfortunately, if there is no police report he will need to locate witnesses to the accident who are willing to come to court and testify.

Sure, plus he could hire a lawyer to file the small claims action which is money out of his pocket. As Craig says, how much money and time is he willing to spend to chase $1,000 around the block? Exactly, if the insurance company is saying you will get the $1000 back after a year we are only talking about a loss of about $10 at current interest rates.

Controversies

In 2009, the company was sued for allegedly deceiving policyholders by employing illegally-operated, unlicensed body shops to make repairs on vehicles for their clients in order to save money. The class action lawsuit of Blue Ash Auto Body Inc. v. Progressive Insurance is pending in Ohio.[14]

In 2007, the company apologized after it was revealed they hired private investigators to infiltrate a church group and pose as congregation members to collect information on litigants seeking redress from the company. Another lawsuit was filed by the litigants over the affair against the company for invasion of privacy and fraud.[15]

In 2002, the company settled with the State of Georgia in a class action lawsuit over diminished value claims brought by policyholders.





I was in an accident in the '80s (With Progressive as Carrier) they attempted
to deny UM Medical coverage (A Paltry amount of Coverage, $10K).
An Enlightened Juris Doctor in Atlanta had some associate in his firm send Progressive a
"Bend Over,Blindfolded,and give us your Bank Account Routing Codes" letter.
'Overnight, We both got checks for $10K, EACH.

Progressive HAS the Worst customer No-Service record of ANY USA Insurer.

I am wondering of this form a different perspective. The other vehilce was modified, ie lifted. Did the bumper height meet the regulations of the state? If not, then could the other driver be faulted on that alone? Obviously a can of worms. I wonder from the other perspective of people altering taillights. Some of them cover over half the OEM area. Many times it is hard to notice weather they break or not.
