I think there is a little undue skepticism. It doesn't sound like the kind of thing that would get scattered all over the news. It's not as if every single crime in the US makes the news. Certainly not with as much crazy stuff that goes on today.

I don't understand why the OP is being harassed as if he made it all up. There are so many people on this forum who correctly espouse innocent until proven guilty. Maybe it's time to practice that.

Frankly, I couldn't care less what the naysayers believe. I didn't post this story for it to be fact checked or nit picked. I am not going to divulge my friends name or location. He's still dealing with the "I killed someone" thing while also having people tell him he is a hero. My god daughter didn't seem herself either and I do not know how she is dealing with this. I can tell you it happened this past weekend. One of the most astonishing things is that my friend is a near cripple from unrelated spinal injuries. Apparently parental instinct trumps all.

What I have been reading tells me that you should be the Governor of WI since he too possesses the "Frankenstein Veto" like you. Love the part where you bold parts of a sentence.

The public duty doctrine has long protected municipalities from negligence claims because it establishes that “[t]he duty to provide public services is owed to the public at large,” not to any specific individual. Warren v. District of Columbia, 444 A.2d 1, 3 (D.C. 1981) (en banc). The rationale is straightforward: Courts and juries are illequipped to review legislative and executive decisions about how to allocate limited municipal resources to best protect the public. See Morgan v. District of Columbia, 468 A.2d 1306, 1311 (D.C. 1983). And because police must often make splitsecond decisions in the face of uncertainty and danger, the doctrine recognizes they need broad discretion to act without fear that a jury will second-guess their judgment with the 20/20 vision of hindsight. Id. If the police owed an enforceable duty to each person, then “every complaint — whether real, imagined, or frivolous — would raise the spectre of civil liability for failure to respond.” Id. The doctrine, however, is no license for carelessness. There are sufficient mechanisms to control the behavior of errant police, including internal disciplinary procedures and criminal prosecution. Id. at 1312.

Who cares? When you need "help" be sure and dial 911 so that you can receive all the government you are paying for. When and if they show up, you'll feel better about yourself knowing "the system is working".

Now you say "Who cares?"? You were the one that fabricated the crazy point and now you can't back it up except with "Who Cares?"?

Well, when you are done with beating that strawman, perhaps you can use common sense to handle a situation. That or maybe call a "Time Out".

from the link you provided:

"When there is only a general duty to protect the public, there is no duty of care to an individual citizen which may result in liability. In short a duty to all is a duty to no one."

Did you pick up on that one? THEY DON'T OWE ANYONE ANYTHING - REPEAT - NEWS FLASH - NEWS UPDATE THEY DON'T OWE ANYONE ANYTHING. Keep drinking the Koolaid, it must taste good going down!

I'm sorry. What is your point? It doesn't owe any one citizen a thing under certain circumstances. You probably don't want to read the entire article. Much better to cherry pick a line.

Quote:
In the context of the public duty doctrine, to establish a special relationship, the plaintiff must show (1) some form of privity or direct contact between the government agency and the plaintiff that sets the plaintiff apart from the general public; (2) the agency gave the plaintiff specific assurances that resulted in the agency undertaking a duty; and (3) the plaintiff justifiably relied upon those assurances. [O'Brien v. City of Tacoma, 247 Fed. Appx. 58 (9th Cir. Wash. 2007)]
Context helps. Try not to cherry pick one line out of an article. The rule is to prevent people like you from cherry picking one line and tossing lawsuits making them a "McDonnalds" case and responsible for you spilling coffee on your crotch.

Like I said, next time you need help, dial 911 and wait for help to arrive. In the unlikely event help does not arrive, try suing them for breaching their fiduciary duty to you. Let us know how that turns out.

In a hurried approach he kicked the door of the car, with the guy half way in reaching for the child on the other side. Mind you my buddy is not a small framed dude either. I wouldn't really call it a street fight, guy never stood a chance, my buddy had already crippled him before he even knew what happened. The severe ass beating occurred thereafter.

I think we both know how that will be since the case is already laid out in court. They are to protect IN GENERAL and not YOU specifically. Again, what you ask is the impossible. In short, you want a cop by your side protecting you AND he cannot be intrusive. You want it BOTH ways and when you cannot have it, as per usual, you declare "The system sucks". Thus generating a complaint for you regardless of which way it goes.

There is no satisfying people like you who demand the impossible. Unlike Goldilocks and the 3 bears, there isn't going to be a "just right". In the unlikely event there is, you'd still find a way to gripe. I doubt a god or gods will be able to placate you.
