Exclamation sneaky cop alert !!!

i typically slow down for construction zones for 2 reasons: 1- fear of "doubled" fines, and 2- safety

fear of #1 just went thru the roof!

Here's is a good question. Can you just ignore the guy when he motions you to pull over? Or do they send a car after you. Up here the cops stand on the road like that in the city and wave you over if you are speeding (they sometimes have a partner on a Harley in case you don't stop). But couldn't you just say you didn't know it was a cop and that you usually don't stop for construction workers? I am pretty sure around here they have to be in uniform to ticket you.

Ontario regs.

For those of us who reside and travel in the province of Ontario, the specific Highway Traffic Act of Ontario regulations are as follows:

Power of police officer to stop vehicle

216. (1) A police officer, in the lawful execution of his or her duties and responsibilities, may require the driver of a motor vehicle to stop and the driver of a motor vehicle, when signalled or requested to stop by a police officer who is readily identifiable as such, shall immediately come to a safe stop. R.S.O. 1990, c. H.8, s. 216 (1).

Offence
(2) Every person who contravenes subsection (1) is guilty of an offence and on conviction is liable, subject to subsection (3),

(a) to a fine of not less than $1,000 and not more than $10,000;
(b) to imprisonment for a term of not more than six months; or
(c) to both a fine and imprisonment.

Escape by flight

(3) If a person is convicted of an offence under subsection (2) and the court is satisfied on the evidence that the person wilfully continued to avoid police when a police officer gave pursuit,
(a) the person is liable to a fine of not less than $5,000 and not more than $25,000, instead of the fine described in clause (2) (a);
(b) the court shall make an order imprisoning the person for a term of not less than 14 days and not more than six months, instead of the term described in clause (2) (b); and
(c) the court shall make an order suspending the person’s driver’s licence,
(i) for a period of five years, unless subclause (ii) applies, or
(ii) for a period of not less than 10 years, if the court is satisfied on the evidence that the person’s conduct or the pursuit resulted in the death of or bodily harm to any person.
Lifetime suspension
(4) An order under subclause (3) (c) (ii) may suspend the person’s driver’s licence for the remainder of the person’s life.

as you can see, there is a caveat that the "police officer be immediately recognizable as such"

But, these regulations pertain to Ontario only. Hope this helps.

I somehow don't think that the concept of freedom includes being free to travel through construction zones at speeds that we, as a society, have deemed unsafe. That same slippery slope of thinking ends up qualifying true "freedom" as anarchy. I do believe that I live in a land of the free - but that very freedom should not and cannot come at the expense of endangering others.

No flame but how is this entrapment? I don't think it even comes close maybe Narwal of LGB can elaborate. I hang around lots a lawyers and learn alot about law and I don't think this falls under entrapment.

While sneaky, underhanded, and just plain unethical, it is not entrapment. They are not forcing you to drive fast in the construction zone. If they were truly interested in safety instead of revenue generation, they would have fully uniformed officers working the area in a highly visible fashion as to deter the speeding.

Entrapment is when they tailgate you untill you speed up over the limit, and then light you up to give you your ticket. There are a couple of "officers" in the town of Boyd that will try this at night when they get bored.

It is not entrapment. And I agree, you shouldn't be speeding through construction zones... although if your construction zones are anything like our constructions zones, a lot of the time it is all cones and no action! It just amazes me that Americans put up with this.

Anyway, high visibility policing is best for road safety: the safest speed trap is the one that never catches any motorists, because they are all within limits.

will all of you sniveling milquetoasts please either stick to the right lane or have the decency to move outta my way when i flash the hellas and sound the fiamms when im trying to overtake you in the school zone! PLEASE !!! :p

actually... i got my 1st ticket in over 12 years about 2 years ago near the airport on atlanta's loop interstate I-285, which is posted at 55mph. the guy cut me some slack and wrote it up under 75. i thought oh, maybe $100. atlanta has new systems that let you pay via CC over the phone or on the web.

my ticket = $325 !!!
that would be $650 in a "doubled fine" zone.

FYI- the speed limit on unmarked roads in residential and business developments is 25 in most states, and 30 in some. do all of the moral police responding earlier adhere to that law? i think not.

i drive slow in my neighborhood out of respect to the safety of residents (read children), not due to the "rules" imposed by the authorities.
