Read my posts on the subject.

There was a direct, clear and unambiguous court order on the subject.

To act, sua sponte and contramand a direct court order is contempt of court.

California Penal Code Sec. 166 states, inter alia:

§ 166. Criminal contempts...

(a) Except as provided in subdivisions (b), (c), and (d), every person guilty of any contempt of court, of any of the following kinds, is guilty of a misdemeanor:

... .

(4) Willful disobedience of the terms as written of any process or court order or out-of-state court order, lawfully issued by any court, including orders pending trial.

(5) Resistance willfully offered by any person to the lawful order or process of any court.


Subsections 4 and 5 probably cover the Sheriff's actions.

Your comment regarding "class envy" is patently absurd and does not deserve a reply.

Given the fact that the outrage regarding the Sheriff's action was widespread, instantanuous and universal, "class envy" is not even an issue.

If you want to think it is class envy then (as Carlos wrote) so be it.

Whether you think this is a case of class envy does not, however, change the fact that the L.A. D.A. is a celebrity whore. It is not just my opinion, it is an opinion widely shared by many others.

The same thing that's wrong with minimum sentencing and removal or attenuation of discretionary sentencing -- it removes the human from the equation and turns justice into law. Are mistakes made in discretionary sentencing? Undoubtedly -- humans make mistakes, it's all part of the human condition. In court, I'd rather be tried by humans and sentenced by humans than by a justice machine. The notion of, "Convicted of XXX do YYY" is frighteningly simplistic to me.

The worst possible thing that could have happen to a Paris Hilton is not that porno of her hit the internet. Far worse for her would have been nobody giving a *****. Those people are in a sense, like a politician -- they thrive on public interest in their lives and in their Olympian pronouncements. They really do believe that everything they say or do is important. And fools that we are, we reinforce that belief by our unstoppable adoration. We make them important in our lives, certainly not the reverse.

The key to success in punishment of people of this sort is to remove from them the aura of celebrity and importance. Martha Stewart is still a very important celebrity because the justice system targeted something that left the public adoration undiminished. But the sentencing was within the guidelines. In Stewart's case, was justice served or was law served?

I expect the worst from people. Not everything. Just people. Therefore, my calculations usually include those. Anything else that somebody does is icing on the cake.

There are no other options................

However, I have some experience in walking around thinking that most people are a bunch of morons. It's not a pretty situation.

You can extrapolate the same behavior toward people who will behave badly or do you harm............

I do not gloat over another person's misery (well, I would like Castro and his ilk suffer a slow, painful and long death, but that is just personal). But after watching PH strutting around with her pouty face, it sure felt good to see her whining face in the back of the patrol car.

If just one celebrity and celebrity wanna be gets teh message that if you f**k with the law the law will f**k with you, then it was all worthwhile!

Well stated (again!!) There's a good argument that in this particular situation the punishment does indeed fit the crime and that similarly situated people need to be treated equally.

Sheriff Baca needs to be aware of this, and from what has come out lately, and from Mel Gibson's bout with the law, the LASD sometimes evidently appears to be protecting celebrities.

This latest caper seems to have brought the issue to a head, and the Sheriff seems to have been contravening a direct sentencing order of the Court. This he does at his peril.

Publicity and public relations are only one aspect, and not a critically defining one, in the administration of jail procedures. A Judge's direct order in sentencing takes precedence over all of that.

Properly noticed motions to modify a sentence may be made anytime, by Criminal defense counsel.

The Sheriff still needs to be held accountable here.
