What were the terms that you agreed to?

Still if they shiped you the wrong stuff, then even if you agreed to something crazy, they are still at fault, and the bank knows that (when you explain it).

Wow I can;t believe that kind of customer service.

I was going to order 2! different rebuilt motors + transmissions from them because it was going to be the same price as one rebuilt from metric.

That is such bs customer service...hanging up on someone....wow.In that case anybody want a perfect body 280ce for maybe a diesel swap?

The terms and conditions of doing business with them are outrageous. They make you agree that you will pay ALL shipping, no matter what. And, they make you agree that the only way you can have a legal beef with them is in an arbitration proceeding in Muncie, Indiana. Who is ever going to do that?

wow man, even if they totally screw up and ship you a sea container load of just pure crap? No wonder they have you fax in your life to them.

Did you call your credit card yet? I'm interested to know how this pans out. Most merchancts will bock about return shipping, and offer you a big discount on your next order in lieu of refunding shipping charges.

But if they totally screwed up, that is just rediculous that they won't own up to it. For crying out loud, you cant use your car because it's apart in your Garage right? After you get this all sorted out, will you consider www.peachparts.com for your next purchase?

Wow, I'm shocked.

I remember a while back I told a Merchant..., I need these parts ($500) NLT friday, and I ordered them on wednesday... I told him if they werent here by that day, I would refuse the package, he agreed. I paid for the next day air shipping BTW. Well it showed up monday, I told fedex, send it back. Their worldpac warehouse people dropped the ball as it turns out. But of course I did business with them before and after that because of great service.

But usually I try not to put that much pressure on people, but sometiems when you are trying to go on a trip you must insist. I ended up driving about 400 miles to get the parts I needed on a front end rebuild because I had to get it done.

oh I just thought of something. Does your invoice reflect the part numbers that you wanted to order? If so, I think you can get them.

If they have the wrong numbers on the invoice, then I think youll just have to deal with it if you signed it. Basically they pulled wool over your eyes in this case. Shady business tactic...

Other options after you call your bank...you will have to determine how much your time is worth after that...maybe this bad PR stunt will hurt them in the pocket enough to revamp their policies.

Again, good luck man. I've dealt with this before, so I know what you mean.

That wouldn't be a good move. If you think it's bad to attempt to return a shock absorber, you ought to see what happens when Adsitco sells you a transmission that's a POS. BTW, they do take it back..........you pay the shipping............and they take back the second one...........and the third one...........

Thankfully, it's not my personal experience but was relayed to me by an indy who installed the transmission four times for the customer.

I am currently waiting for my credit card company to send me the paperwork for chargeback. I told them exactly what was going on, and they did confirm again with me that their terms mean nothing if they send the wrong merchandise.

johnboy12 and omegabenz - I am unable to answer either of your questions because of their crappy setup. When I ordered the shocks, they don't have you look your car up and select the part you want, they have you pick your brand, then if you want front or rear, then they just have you put your car make and model, so I put 1980 Mercedes 300SD W116. They also sent no invoice to me in the package.

The bank was saying though, that when I agree to terms, that they are also agreeing to terms, to send the correct part. So by them not keeping their terms, they in effect void any terms I agree to.

If you read the opinion from the Indiana appellate court attached to omega's post above, you'll see that the law pretty much everywhere is that a click is just as binding as a signature.

Although (from memory) I believe that it states that all sales are final, and that there are no returns, a sale is a complex transaction which is offer and acceptance, and delivery of the agreed upon goods. If the agreed upon goods are not delivered, there was a breach of contract on the seller's part which releases the buyer from his obligation.

The Bilstein part number should be on the end of the box. Should start with B46 or B36.
The part number on the box would be your best proof, because it is what you received. Shoot me that number and I will get you set up.

To bad someone has to go through all this trouble.

If you read this in Omega's post, you will understand what you're facing.

It would probably be a better idea to find out what these shocks will fit on, ebay them, and never do business with these losers again.

I agree with Tyler.

In something this small ($), you risk much more in legal fees et al than you have lost so far, some times the bad guy isn't worth beating.

That Adsit-Gustin appeals decision is pretty interesting. For those who have not read it yet, Adsit as awarded no damages at trial but was awarded $500 attorney's fees. Adsit appealed and lost the $500.

I wonder how much the Gustins ended up paying for their representation. Probably a lot more than the seat covers were worth.
