From a legal website regarding protesting in DC, but charges are charges..

Incommoding. This is blocking vehicle or pedestrian traffic on the streets, sidewalks, and other walkways. This is by far the most common charge we see when protestors sit down in the street. Sidewalks are trickier because you generally have a right to engage in free speech activities on the public sidewalks; but if you so clog them that no one else can use the sidewalks, you might be charged with incommoding.

Unlawful entry on property (trespassing). Remaining on private property after being told to leave is punishable

The campus police had "the right" to arrest or issue civil citations for trespass; they also had the right to physically arrest the persons, but given the range of methods and materials available to them, the use of chemical agents in a non-violent sit-in, especially when the stated goal of the campus police was to remove camping equipment, does seem over reaction.

In the end, the protestors achieved more publicity than they could ever imagine. It seems that some elements of "the establishment" and law enforcement learned nothing from the past.

While that has some truth, here is the other end of it. Given human nature, no action would be seen as weakness and the next attempt will be even more outrageous as will the next one. Perhaps if they had squashed this crap back when with the abortion protesters and their chains and lying down in the road, it might not be where it is today with vandalism, sabotage, harrassment and murder once in a while.

The cops in that department are all laughing about this.

One of them told me years ago, in the cops' world there are only TWO kinds of people.

1. US.
2. Everybody else


In fact, I bet their POA is already selling T shirts to them with that picture on it.

It is an absolute classic, a gem.

I wonder what the caption says.

I will bet you that while they may not be allowed by the brass to sell them at the gift shop at the Academy, someone is selling a LOT of them already.

And guess who will be buying them up.

I understand that the protesters were probably breaking a few laws. What I would like to know is why you believe that the police had the "legal right" to do what they did. I don't know the answer to that question, but the pepper spray approach used by the UC-Davis cop seems unorthodox to me.

The cop should have executed the protesters one by one. After all they were breaking the law. Maybe that would make TxJake happy.

If a person doesn't want to have the potential to be sprayed, beaten, arrested, etc, then they should go through the proper channels to protest. Otherwise, this happens.

Think on the bright side, he could have gone to town on them with a riot shield and bludgeon. Or a beanbag shotgun. Given the options, I'd take pepper spray.

Why stop there? Just execute the protesters on the spot. Imagine how happy that would make you.
